TERMS AND CONDITIONS
Reservations and payment policy
A deposit of $1,000 per person is required with your reservation form to confirm a tour. Full payment is due 60 days prior to the tour departure date. All payments must be made in U.S. dollars. Your reservation may be cancelled and cancellation charges applied as described below if final payment is not received within the specified time.
Cancellations and refunds
All requests for cancellations must be received in writing. All payments made will be refunded for cancellations made prior to 60 days before the departure date, less a handling fee of $200 per person. Deposits are not refundable for cancellations made less than 60 days before the tour date. Deposits and final payments are not refundable for cancellations made less than 45 days before the tour date. No refunds will be made for any portion of the tour not completed, regardless of the reason. No refunds will be given due to mechanical breakdown or operational problems with participant’s motorcycle. Trip cancellation insurance is highly recommended.
Responsibilities
Eclipse Motorcycle Tours (EMT) will arrange for and conduct your tour and exercise all due care. However, EMT, their officers, directors, employees or representatives shall not be held responsible for and will accept no liability for any claims, property loss, expenses or damages arising out of the following:
Personal injury, sickness, accident or death caused for any reason while participating on a tour whether due to ownership, maintenance, use, operation or control of any motorcycle, automobile, vehicle, common carrier or any other conveyance used in this tour.
EMT will assume no liability due to any cause whatsoever, whether caused by failure, delay, acts or omissions, or loss occurring during a tour due to actions of hoteliers, weather, mechanical breakdown, equipment failure, other independent providers, acts of God, other drivers, tour participants or any other causes beyond the control of EMT.
Baggage and personal effects, including items purchased, are the sole responsibility of the owners at all times. EMT will transport baggage on the tour under the expressed condition that it will not be held responsible for any loss or damage occurring for any reason whatsoever including but not limited to theft, accident, fire, rain or adverse weather.
Cancellation
EMT reserves the right to cancel any tour prior to departure for any reason whatsoever. In the event of tour cancellation, EMT will provide an alternate tour date or refund all payments without further obligation on the part of EMT. EMT reserves the right to change any tour, hotel, route or itinerary as it seems necessary or desirable. EMT is not responsible for any travel arrangements, costs, or fees affected or imposed due to our cancellations or changes.
Alcohol
EMT expressly prohibits the consumption of alcohol or illegal drugs before or during the operation of motorcycles on our tours. Anyone found to have consumed alcohol or illegal drugs before or during the riding portion of our tours will be expelled or prohibited from riding the remainder of the tour without a refund of the tour fee.
Weather
Under no circumstances can EMT be held responsible for rain, snow or any other weather condition, nor can tour participation be canceled or amended by tour participant at any time on the basis of any weather condition. All tour participants are responsible to provide rain suits and clothing suitable for any and all weather conditions encountered.
Safety
EMT will provide a tour guide and a support vehicle but will accept no responsibility or liability for the riding ability or the safety of the tour participants. EMT encourages the use of helmets and other protective clothing but makes no demands over and above State laws that govern motorcycle safety. Each tour participant is responsible to ride at speeds and in a manner that is compatible with the experience level of the participant. EMT reserves the right to cancel or remove any tour participant for any reason whatsoever at EMT’s sole discretion without a refund.
Waiver Agreement
My payment of a deposit constitutes my acceptance and understanding of the Terms and Conditions, and information contained herein. I further understand and accept that the Eclipse motorcycle tour and its activities involve risk of personal injury or death and damage to or loss of property. In consideration of the benefits to be derived from my participation in this tour I hereby accept all risks of personal injury and property damage arising from my participation in this tour, and I hereby agree that I, my dependents, my heirs, executors and assigns do release and hold harmless Eclipse Motorcycle Tours and its employees, officers, owners, directors, trustees and representatives from any and all claims, including claims of illness, bodily injury, death or property damage or loss, however caused, arising from or related to the tour. Further, by making my deposit or by signing this form I certify that I do not have any physical, mental or other condition or disability that would create a hazard for me or any other tour participant. I also certify that I am over 25 years of age and am in possession of a current valid motorcycle operator's license, and I understand that the choice of wearing a safety helmet and other protective gear is solely my own. I understand that I am responsible for the first $1,000 in damages to the motorcycle in case of accident or theft. I have carefully read the terms and conditions and this waver agreement, and I will abide by everything as stated herein or elsewhere published by Eclipse Motorcycle Tours.
